Please read these Terms and Conditions ("Terms") carefully before using the Imagine IT Solutions website (the "Site") or engaging any of our services. By accessing the Site or engaging our services, you agree to be bound by these Terms.
By using our Site, you confirm that you are at least 18 years of age, have the legal authority to enter into these Terms, and agree to comply with all applicable laws and regulations.
Imagine IT Solutions provides information technology consulting, software development, cybersecurity, and Autodesk software reselling and training services in Namibia. Specific deliverables, timelines and pricing for any engagement are agreed in a separate written proposal or service agreement, which takes precedence over these Terms in the event of conflict.
All content on this Site — including text, images, logos, graphics and software — is the property of Imagine IT Solutions or its licensors and is protected by applicable intellectual property laws. You may not reproduce, distribute or create derivative works from any content on this Site without our prior written consent.
Custom deliverables created for clients (e.g., software, designs, documentation) remain the property of Imagine IT Solutions until full payment has been received, at which point ownership transfers as specified in the relevant service agreement.
Autodesk software products resold or facilitated by Imagine IT Solutions are subject to Autodesk's own End User Licence Agreement (EULA). It is your responsibility to review and comply with the applicable Autodesk licence terms before using such software.
Unless otherwise agreed in writing:
To the fullest extent permitted by applicable law, Imagine IT Solutions shall not be liable for any indirect, incidental, special, consequential or punitive damages arising out of or related to your use of the Site or our services, even if we have been advised of the possibility of such damages.
Our total liability for any claim arising out of or relating to our services shall not exceed the amount paid by you for the specific service giving rise to the claim in the preceding three months.
The Site and its content are provided on an "as is" and "as available" basis without warranties of any kind, express or implied. We do not warrant that the Site will be uninterrupted, error-free or free of viruses. Technology recommendations made through the Site are for general informational purposes only and do not constitute professional advice.
Both parties agree to keep confidential any proprietary information disclosed during an engagement and not to disclose such information to third parties without prior written consent, except as required by law.
These Terms are governed by and construed in accordance with the laws of the Republic of Namibia. Any disputes arising from or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Namibia.
We reserve the right to modify these Terms at any time. Changes are effective immediately upon posting to this page. Continued use of the Site after changes are posted constitutes your acceptance of the revised Terms.
